ADAMS TOWNSHIP BOARD OF SUPERVISORS REGULAR MEETING

I.  CALL TO ORDER:
Chairman Dennis Richards called the meeting to order at 5:00 P.M. in the conference room of the Adams Township Municipal Building.
II. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was said by all present.
III. ATTENDANCE:
Those in attendance were Supervisors Dennis Richards, Dennis Gdula, Brian Schrader, Joseph Slonac and Anthony Christ; William Barbin, Solicitor; Diana Baxter, Secretary; and three (3) residents.
IV. PUBLIC COMMENT PERIOD FOR AGENDA ITEMS AND PRIOR MEETING MINUTES:    
Mr. Richards stated at this time the Public has the right and the opportunity to comment on any item from the previous meeting minutes.   No comments or questions.
V. MINUTES: 
Mr. Richards stated everyone had a copy of the January 4, 2016 meeting.   He asked all Board members to read the minutes.  Mr. Richards asked for a motion to approve the minutes presented. Mr. Gdula made the motion to accept the minutes, Mr. Christ seconds this motion.  With all in favor, motion passed.
VI. TREASURER’S REPORT:
Mr. Richards asked for the reading of the Treasurers Report.    The General Account Fund showed revenues received totaling $65,777.70, expenditures of $60,469.90 (Check #27881 to #27903) and a balance of $415,831.45.  The Street Light Account Fund showed revenues of $2,031.75, expenditures of $168.47 (Check #1341) and a balance of $29,186.65.  The Fire Protection Account Fund showed revenues of $483.00 (hydrants) and $1,145.78 (Fire Protection), expenditures of $0.00 (Check #-) and a balance of $6,025.13.  The State Liquid Fuels Account Fund showed interest of $49.05 and expenditures of $0.00 (check #---) leaving a balance of $113,262.21. 
VII. CORRESPONDANCE:
A copy of the tentative list of functions scheduled for the Adams Township No. 2 Fire Station for 2016 was presented.  Mr. Barbin said they are required to inform the Board on a yearly basis of their activities.
A letter from EMS regarding the Winter Storm Jonas and to keep track of overtime, supplies used, etc. in case the President declares a Federal Disaster from the hours of 2400 Friday, January 22, 2016 until the middle of the week.  Discussion:  Mr. Richards said everything must be documented.
II. OLD BUSINESS
Mr. Richards stated at the reorganization meeting a discussion came up on appointing someone to fill the vacancy created by the death of James Dusack on the Adams Twp. Municipal Authority.  Upon research and talking with Mr. Sivec, this position was filled February 2015.  Sarah Zajdek to Mr. Dusack’s term and Fred Brown to Skip Kelly’s term.
Mr. Richards asked for a motion to release the road bond for Gdula Street, Lloyd Street and Pipline Road held by D & F Loggiing. Mr. Gdula stated he has inspected these roads and there is no damage.  Mr. Gdula made the motion to release the bonds for D & F Logging.  Mr. Slonac second this motion, with all in favor, motion passed.
Mr. Richards asked if the Board had any other old business they would like to discuss.    None is forthcoming.
IX. NEW BUSINESS

Mr. Richards asked for a motion to purchase six (6) new tires for the Freightliner truck. Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.   
 Mr. Richards asked for any other new business.  None was forthcoming.
X. PUBLIC GENERAL COMMENT PERIOD
Mr. Pat Replogel spoke regarding the snow removal from Storm Jonas this past weekend.  He felt the township road crew should have acted faster on coming out to clear the roads due to emergency (fire and ambulance) equipment’s need to reach victims should it occur.  Mr. Gdula and the Board discussed this issue.
Mr. Mark Bucci asked what is going on with the Boundary status.  Mr. Barbin explained what is going on that Richland Township appealed to the State Supreme Court and we won’t give up.
XI. ADJUORNMENT
Mr. Richards stated with no further township business to conduct he would entertain a motion to adjourn. Mr. Christ made the motion to adjourn and Mr. Schrader second this motion.    With all in favor, motion passed and meeting adjourned at 5:24 P.M.

Mr. Richards stated everyone had a copy of the December 14, 2015 meeting.   He asked all Board members to read the minutes.  Mr. Richards asked for a motion to approve the minutes presented. Mr. Christ made the motion to accept the minutes, Mr. Gdula seconds this motion.  With all in favor, motion passed.
VI. TREASURER’S REPORT:
Mr. Richards asked for the reading of the Treasurers Report.    The General Account Fund showed revenues received totaling $17,907.56, expenditures of $74,529.14 (Check #27842 to #27880) and a balance of $410,523.65.  The Street Light Account Fund showed revenues of $0.00, expenditures of $4,665.53 (Check #1338 to #1340) and a balance of $27,323.37.  The Fire Protection Account Fund showed revenues of $0.00 (hydrants) and $0.00 (Fire Protection), expenditures of $3,696.95 (Check #1071 to #1076) and a balance of $4,396.35.  The State Liquid Fuels Account Fund showed interest of $0.00 and expenditures of $0.00 (check #---) leaving a balance of $113,213.16.  Mr. Smith thanked the Board for the great fiscal management of township funds and asked for a motion to put $100,000.00 into a reserve fund.  If this money is not needed to meet payments, then it can be used towards future road work.  Mr. Smith made the motion, second by Mr. Christ.  With all in favor, motion passed.
VII. CORRESPONDANCE:
A letter was read from Forest Hills Municipal Authority regarding notifying the Board we have one (1) year to have our sanitary sewer air pressure testing on all buildings.  Discussion:  Mr. Richards and the Board agreed we need to have our buildings tested and Mr. Richards asked for a motion to have Forest Hills Municipal Authority do the testing.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
II. OLD BUSINESS
Mr. Richards stated regarding Mr. Hoffman’s request to make the medical payment for three months to his supplemental payments he would like to discuss this.  Mr. Hoffman would be entitled to the three months of the supplemental payment but not the regular medical cost payment.  He must present an invoice that he paid the insurance and the township will reimburse him for this.  Mr. Richards asked for a motion to pay the three months of supplemental insurance coverage for Mr. Hoffman.  Mr. Slonac made the motion, second by Mr. Christ.  With all in favor, motion passed.    
 Mr. Richards asked if the Board had any other old business they would like to discuss.    None is forthcoming.
IX. NEW BUSINESS

Mr. Richards asked for a motion to approve the road bond for D&F Logging for $6,250.00 for Pipeline Road.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a discussion on allowing a road bond for D&F Logging for Gdula and Lloyd Street in Dunlo.  Discussion occurred on this request and the board allowed up to three (3) loads to be hauled with a bond.
     Mr. Richards asked for any other new business.  None was forthcoming.          
X. PUBLIC GENERAL COMMENT PERIOD
               Mr. Oswalt thanked the Board of considering him for the vacancy on the Board.  He was interested in the local government.
                Mr. Richards thank all three people for their interest in the vacancy.
                XI. ADJUORNMENT
                Mr. Richards stated with no further township business to conduct he would entertain a motion to adjourn. Mr. Christ made the motion to adjourn and Mr. Schrader second this motion.    With all in favor, motion passed and meeting adjourned at 1:38 P.M.

REORGINAZITIONAL MEETING
JANUARY 04, 2016
 
CALL TO ORDER at 1:00 PM by Dennis Richards with the Pledge of Allegiance being said by all present.  Those in attendance were Supervisors Anthony Christ, Brian Schrader, Dennis Richards and Dennis Gdula; Diana Baxter, Secretary; Police Chief Moss; Sam Birch, Road employee and three (3) residents.
Mr. Richards asked for a motion to appoint a temporary Chairman to conduct the reorganization meeting.  Mr. Richards named Mrs. Baxter, second by Mr. Gdula. With all in favor, motion passed.
Mrs. Baxter asked for a motion to name a Chairman of the Board of Supervisors.  Mr. Gdula made a motion to appoint Mr. Richards as Chairman of the Board of Supervisors.  Mr. Christ seconds this motion.  With all in favor, motion passed. 
Mr. Richards asked for a motion to name a Vice-Chairman of the Board of Supervisors.  Mr. Christ nominated Mr. Gdula, second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards stated the Board has received interest from three very good candidates for the replacement seat of William Smith.  Mr. Slocan, Mr. Oswalt and Mr. Bucci.  Mr. Richards asked for a motion to name a person to complete the term of William Smith, Township Supervisor, whose resignation is effective January 4, 2016.  Mr. Gdula made a motion to appoint Mr. Joseph Slonac, Mr. Christ second this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Diana Baxter as Secretary-Treasurer for the Board of Supervisors with a 2% increase in rate.  Mr. Christ made the motion, second by Mr. Gdula.   With all in favor, motion passed.
Mr. Richards asked for a motion to retain William Barbin as Solicitor for Adams Township Board of Supervisors.  Mr. Gdula made the motion; Mr. Christ seconds.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Sam Birch as a Level 1 Equipment/Road Department Employee for Adams Township with a 2% increase in rate.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Justin McKnight as a Level 2 Employee classified under the Road Department for Adams Township with a 2% increase in rate.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Travis Ladika as Level 3 Employee classified under the Road Department for Adams Township.  Mr. Gdula made the motion second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Kirk Moss as full time Police Chief for Adams Township with an increase pre-established in his contract.  Mr. Gdula made the motion, Mr. Christ second this motion.  With all in favor, motion passed
Mr. Richards asked for a motion to reappoint Ted Paluch, and John Heming as Full Time Police Officers with the increase prescribed by the contract.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Rick Keller, John McKnight, Scott Croyle, Lee Hill, Steve Suckenik, Dwight Keim and Kyle Wirick as Part Time Police Officers at a pay rate established by the contract.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Mark Miller, State Animal Control Officer as Animal Control Officer for the Board of Supervisors.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Cambria County Building Codes as Compliance Officer for the Board of Supervisors.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint Fred Brown as Township Surveyor for the Board of Supervisors.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to reappoint the Eads Group as Township Engineer for the Board of Supervisors for 2016. Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint a member of the Board to the Cambria County Sewage Agency.  Mr. Christ nominated the Dennis Gdula to be the representatives for the Board.  Mr. Schrader seconds this.   With all in favor, motion passed. 
Mr. Richards asked for a motion to appoint an alternate member of the Board to the Cambria County Sewage Agency for the Board of Supervisors for the year 2016.  Mr. Gdula nominated Mr. Christ.  Mr. Schrader second this motion.  All in favor, motion passed.
Mr. Richards asked for a motion to appoint a member of the Board to the Cambria County Building Codes Agency for the Board of Supervisors for the year 2015.  The meetings for 2016 will be held the 3rd Wednesday every month at 7:00 am in the Ebensburg Municipal Building.  Mr. Christ nominated Dennis Gdula as the representatives for the Board.  Mr. Schrader seconds this motion.  With all in favor, motion passed.  
Mr. Richards asked for a motion to retain Berkheimer & Associates as Earned Income Tax Collector for the Board of Supervisors at a rate of 1.65% for commissions.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint a member of the Board to the Cambria County Association of Township Officials and also 2 alternates for the Board of Supervisors for the year 2016.  Mr. Christ made the motion for Dennis Richards to be the representative, Mr. Schrader seconds this motion.  With all in favor, motion passed.
Mr. Richards made a motion to appoint Tony Christ and Brian Schrader as the 2 alternates for the Board of Supervisors to the Cambria County Association of Township Officials for 2016.  Mr. Gdula second this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint a member of the Board to the FH Alliance for Board of Supervisors for the year 2016.  Mr. Gdula nominated Mr. Christ and Mr. Schrader.  Mr. Christ seconds this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain James Rachael as Act 511 Occupation – Per Capita Tax Collector for the Board of Supervisors.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain US Cleaning Service as Janitor for the Adams Township Municipal Building and District Court Building for 2016.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed. 
Mr. Richards asked for a motion to reappoint Terry Hunter to the Vacancy Board of the Board of Supervisors.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to affirm the employment of Dennis Gdula and Anthony Christ on the road department for the Board of Supervisors.  Mr. Christ made the motion; Mr. Schrader seconds.  With all in favor, motion passed.
Mr. Richards asked for a motion to hire J. Brian Schrader as a working supervisor on the road department for the Board of Supervisors.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain Dennis Richards as a per diem employee for the road crew on an as needed basis for the Board of Supervisors.  Mr. Gdula made the motion, Mr. Christ seconds this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to name Brian Schrader, Dennis Richards, Dennis Gdula, Anthony Christ as assistant secretaries for the Board of Supervisors.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to nominate and appoint a Road Master for the Board of Supervisors. Mr. Christ nominated Mr. Gdula.  Mr. Schrader seconds this motion.  With all in favor, motion passed.
Mr. Christ made a motion to appoint the Board as assistant road masters. Mr. Richards called for a second on this motion, Mr. Schrader second this motion.
Mr. Richards asked for a motion to nominate and appoint a Police Commissioner for the Board of Supervisors.  Mr. Gdula nominated Mr. Christ.  Mr. Schrader seconds this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain the Treasurers Bond at $300,000.00 for the Treasurers of the Board of Supervisors.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain first Summit Bank as depository for the Township of Adams funds.  Mr. Gdula made the motion, second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain FWF Insurance Agency as the carrier for coverage of the Township buildings, vehicles, and workman’s compensation Insurance, errors and omissions policies until the contract date of May 18, 2016.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain Pennsylvania State Association for Borough’s for the Union and Non-Uniform Pension Plans.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, the motion passed. 
Mr. Richards asked for a motion to retain Teamsters & Employers Welfare Fund as medical, dental, eye care and $25,000 death benefit per employee carrier for all full time employees that qualify under the township code.  New Employees must have a thirty- (30) day probationary period before qualifying for this benefit.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain Nationwide Ins. for the disability insurance for all full time employees and a $25,000.00 death benefit.  Mr. Gdula made the motion, Mr. Christ seconds this motion.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain payday as every other Thursday in 2016 with the final pay date for 2016 being December 29, 2016.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to give the Secretary-Treasurer the permission to transfer Township monies within accounts to pay bills falling due between meetings to avoid penalty charges.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to give the Secretary-Treasurer the permission to invest Township monies to gain larger investment margins.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
 Mr. Richards asked for a motion to retain the Secretary’s meeting pay at $40.00 per meeting. Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain the Supervisors meeting pays to be paid according to the population rate allowable for Supervisors meeting pay allowed under the Township Code.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to retain authorization for the Road Masters to make a purchase no exceeding $1,000.00 in materials/supplies without going through a regular scheduled meeting.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint a voting delegate to the State Convention in Hershey, PA for the dates of April 17 to April 20, 2016.  Mr. Schrader made a motion to appoint Mr. Gdula, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to hold Monthly Township Meetings at the Municipal Building, located at 125 Mary Drive, Sidman, PA starting at 5:00 PM on the following dates in 2016: January 4 and 25; February 16 ; March 7 and 28; April 18; May 16 ; June 06 and 27; July 18; August 15; September 12 and 26; October 17; November 7 and 21; December 12, 2016. Mr. Christ made the motion to set the time at 5PM and the meeting dates, second by Mr. Gdula.  With all in favor, motion passed. 
Mr. Richards asked for a motion to appoint Patrick Webb as recording secretary for the Adams Township Planning Commission, at a rate of $35.00 per month.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to pay each Planning Commission member $30.00 per meeting.  They only receive compensation for the meeting they attend.  Mr. Gdula made this motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint Elizabeth Smay, Alternate, to a 5-year term on the Adams Township Zoning Hearing Board expiring 2021.  Mr. Christ made the motion, second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint Ron Young to the Adams – Croyle Recreation Authority for a five year term expiring 2021.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint Peter Skoner and David Knepper to a 5 year term on the Adams Township Municipal Authority expiring 2021.  Mr. Gdula made the motion, second by Mr. Christ.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint someone to a 4 year term on the Adams Township Municipal Authority to fill the vacant term of James Dusack expiring 2020.  Discussion on this motion occurred and was tabled until they called Mr. Ray Weyandt to see if he was still interested.
Mr. Richards asked for a motion to reappoint Sarah Wieczorek to a 5-year term on the Forest Hills Municipal Authority expiring 2021.  Mr. Christ made the motion second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards asked for a motion to appoint Betty George and Ralph Gessner to a 5-year term on the Adams Township Water Authority expiring 2021.  Motion made by Mr. Gdula, second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards asked for a motion to set the Zoning Hearing Board rate at $30.00 per hearing scheduled for 2016.  Mr. Christ made the motion, second by Mr. Schrader.  With all in favor, motion passed.
Mr. Richards asked for a motion to approve the Rules and Regulations for the employees of Adams Township listing holidays, sick time, vacation time, personal time and other regulations for 2016.  If revisions are needed they will be done during the course of the year by motion of the Board.  Mr. Christ made the motion, second by Mr. Gdula.  With all in favor, motion passed.
Mr. Richards asked for a motion to adjourn.  Mr. Christ made the motion, second by Mr. Schrader.  With all in favor, meeting adjourned at 1:22 PM.
