Application for Variance Request.  Hearing #1.

Applicant: George and Sarah White, 4563 Elton Road, Elton PA15934 – Owner

Board Members Present: Pat Mulcahy Vice Chairman, Holly Bodolosky, Steve Paluch, Dennis Bailey-Alternate.

  1. Meeting for George and Sarah White Variance Application began at 5:30 PM. Pledge Allegiance to Flag
  • Application was read aloud by Vice Chairman Patrick Mulcahy and testimony was given by Sarah White. White explained the proposed project to construct a garage/storage building/barn 24’ long x 24’ wide with 17.6’ high.  Mrs. White explained the proposed building would be used for storage and housing a horse and a donkey.  Mr. and Mrs. White are requesting a variance to construct this building without the parcel of property having a primary residence on it.
  • Other people who gave testimony was Melissa Stiles from Codes, Roy Wicks (adjacent neighbor) in favor of the project, Tammy Dunn (adjacent neighbor) in favor of the project and Randy Cortese (surveyor) explained property information.
  • Executive Session was called to discuss the application and testimony of attendees at approximately 5:45 P.M.
  • Meeting resumed at approximately 5:45 P.M. Pat Mulcahy made the motion to reject the variance request due to the parcels of property not having a primary residence on it and the parcels of property not being large enough to support the housing of the horse and donkey in an urban district. The other factor that played into this decision is Mr. and Mrs. White are relocating to an assisted living facility in Windber and would have to travel to their property on Elton Road to care for the animals.  Holly Bodolosky seconded the motion.  Motion passed unanimously.
  • and Mrs. White were not happy with the decision and may appeal.

Application for Special Exception.  Hearing #2.

Applicant: Sarah Joy representing Tower North – Cell Phone Tower Group

Owner of Property:  Daniel and Monica Christ, 130 Rhodes Cross Road, Sidman PA 15955

Board Members Present: Pat Mulcahy Vice Chairman, Holly Bodolosky, Steve Paluch, Dennis Bailey-Alternate.

  1. Meeting for Tower North Special Exception Application began at 6:04 P.M.
  • Application was read aloud by Vice Chairman Patrick Mulcahy and testimony was given by Rebecca Homen of Tower North explaining the proposed project in detail. Homen explained the proposed project to construct a cell phone tower on the Christ Farm.  A special exception is being requested for the construction of the cell phone tower in an agricultural zoning district.
  • Other people who gave testimony was Melissa Stiles from Codes, Daniel Christ property owner, explained the need for additional cell service in the area and that the proposed project would not affect him from continuing to farm his property.
  • Executive Session was called to discuss the application and testimony of attendees at approximately 6:35 P.M.
  • Meeting resumed at approximately 6:38 P.M. Holly Bodolosky made the motion to approve the special exception request. Steve Paluch seconded the motion.  Motion passed unanimously.
  • Meeting was adjourned at approximately 6:40 P.M.

 

Application for Special Exception.  Hearing #3.

Applicant: Vertical Bridge, Jim Kopac agent representative – Cell Phone Tower Group

Owner of Property:  Ron Hudec, 591 Llanfair Road, Windber PA 15963

Board Members Present: Pat Mulcahy Vice Chairman, Holly Bodolosky, Steve Paluch, Dennis Bailey-Alternate.

  1. Meeting for Vertical Bridge Special Exception Application began at 6:40 P.M.
  • Application was read aloud by Vice Chairman Patrick Mulcahy and testimony was given by Jim Kopac of Vertical Bridge explaining the proposed project in detail. Kopac explained the proposed project to construct a cell phone tower on the Hudec property.  A special exception is being requested for the construction of the cell phone tower in an agricultural/residential 1 zoning district.
  • Other people who gave testimony were Melissa Stiles from Codes, Ronald Young (adjacent property owner) in favor of the project, Tammy Ohler property owner, in favor of the project. These individuals also explained the need for additional cell service in the area.
  • Executive Session was called to discuss the application and testimony of attendees at approximately 6:54 P.M.
  • Meeting resumed at approximately 6:57 P.M. Holly Bodolosky made the motion to approve the special exception request. Steve Paluch seconded the motion.  Motion passed unanimously.
  • Meeting was adjourned at approximately 7:00 P.M.
